Affiliate & Advertising Agreement

1. Overview & Parties

This Affiliate & Advertising Agreement ("Agreement") governs the affiliate marketing and advertising relationships maintained by Franklyns Bay LLC ("Company," "we," "us," or "our"), operator of HurricaneShutterCalc.com (the "Site"), with third-party affiliate programs and advertising networks ("Affiliate Partners").

This Agreement also serves as a disclosure document to Site visitors ("you") regarding the commercial relationships that may influence content on this Site, in compliance with Federal Trade Commission ("FTC") guidelines on endorsements and testimonials (16 C.F.R. Part 255).

If informal resolution fails after sixty (60) days, disputes shall be resolved by binding arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules, with the arbitration taking place in Citrus County, Florida. The arbitrator shall apply Florida law.

You and Franklyns Bay LLC agree to bring claims against each other only in an individual capacity, and not as a plaintiff or class member in any purported class, collective, or representative proceeding.

For matters not subject to arbitration, you consent to the exclusive personal jurisdiction and venue of the state and federal courts located in Citrus County, Florida.

10. Modifications to This Agreement

We reserve the right to modify this Agreement at any time. Modifications are effective immediately upon posting to this page. We will update the "Last Updated" date at the top of this page when changes are made. Your continued use of this Site after any modification constitutes your acceptance of the updated Agreement.

We may add new affiliate programs, discontinue existing programs, or change affiliate tracking codes at any time without notice. All material affiliate relationships in effect will be reflected in the current version of this Agreement.
